Stephen Wengraf is a Partner at Rutherfords and has significant experience in dealing with all of the circumstances which may occur if your tenant falls into arrears, breaches the Tenancy Agreement in some way or you want to regain possession.

The agreement between yourself and your tenant is likely to be an Assured Shorthold Tenancy Agreement. If you have a written agreement (and you have served the proper notice), there is an expedited procedure available to recover possession of your property.

If there is no written agreement, you can still recover possession of the property but the process will take longer and is slightly more complex.

It is important to understand that your tenant has security of tenure and if the tenant does not leave voluntarily then you cannot force the tenant to leave without a court order. If they still do not leave, then you will require a Warrant of Possession (executed by a High Court Bailiff). If you were to force your tenant to leave by some other process, then this could amount to harassment.
